The short answer
Aviatrix is a casino game supplied to licensed operators. If the operator holds a Kenyan licence and you are 18 or over, playing it is legal. The licence is the operator’s, not the game’s, which is why this site’s Aviatrix sites comparison puts licence transparency first.
What changed in 2025
The Gambling Control Act 2025 was enacted on 7 August 2025 and came into force on 26 August 2025, replacing the Betting, Lotteries and Gaming Act that had stood since 1966. The main changes that touch players:
- A new regulator. The Gambling Regulatory Authority (GRA) replaces the Betting Control and Licensing Board (BCLB), with a Gambling Appeals Tribunal to hear disputes.
- Online licences. Separate licence categories for online bookmakers, online lotteries and online casinos. An online operator must run an approved gambling control system covering security, payments, under-age protection, responsible advertising, anti-money-laundering and data protection.
- Longer licence terms. Operator licences run for 36 months instead of one year.
- Advertising rules in law. No celebrities, influencers or content creators; no portrayal of gambling as a path to wealth; at least 20% of any advertisement devoted to responsible-gambling messaging; licence number and an addiction warning on all promotional material; pre-approval of marketing by the regulator and the Kenya Film Classification Board.
In 2026 the regulator issued five sets of regulations under the Act, covering licensing, conduct of operations, foreign-based operators, advertising and the appeals tribunal.
What it means at the operator
- Your operator must offer deposit limits and self-exclusion.
- Age verification is mandatory.
- The licence number should be printed on the site. Until BCLB-era licences are renewed you will see formats such as BK 0001228 (bookmaker) and PG 0000452 (public gaming).
- Disputes you cannot resolve with the operator can go to the Gambling Appeals Tribunal.
How to verify a licence
- Scroll to the footer of the operator’s site or app.
- Find the licence number and the company name.
- Check them against the regulator’s register at gra.go.ke.
- If the site says “licensed and regulated” without a number, treat it as unlicensed until proven otherwise.
Offshore operators
International brands such as 1win (Curaçao licence) and 22Bet serve Kenyan players. The Act and the 2026 Foreign-Based Operators Regulations are aimed at operators, and enforcement actions have included payment and domain blocking in the past. For a player the practical consequences are: no Kenyan consumer protection, no access to the Appeals Tribunal, your own responsibility for tax on winnings, and payment routes that change without notice. Our 1win Aviatrix page sets this out in detail.
Licensed operators with Aviatrix and their published licence details: Odibets, Betika, Betkumi (BK 0001228) and Spotika.
Taxes
- Withholding tax on winnings: 20%, deducted by licensed operators before payout.
- Excise duty on stakes, deducted at the time of the bet; the rate is set by the Finance Act and shown in the operator’s terms.
This page is not legal advice
We are players and reviewers, not lawyers. The Act, the regulations and the regulator’s guidance are the primary sources; if you have a dispute with an operator, the Gambling Appeals Tribunal and a Kenyan advocate are the right places to take it.
Frequently asked questions
What is the legal gambling age in Kenya?
18. Operators must verify age and are prohibited from marketing to minors.
Who regulates betting in Kenya now?
The Gambling Regulatory Authority (GRA), established by the Gambling Control Act 2025, which replaced the Betting Control and Licensing Board (BCLB). Licences issued under BCLB continue until renewal, which is why you still see BK and PG numbers in footers.
Is it illegal to play on an offshore site like 1win?
The law regulates operators rather than players. The 2026 Foreign-Based Operators Regulations set out how foreign operators are expected to be licensed to serve Kenyans. The practical issue for a player is that Kenyan consumer protection and the Gambling Appeals Tribunal do not apply to an unlicensed operator.
Are winnings taxed?
Yes. A 20% withholding tax applies to winnings and excise duty applies to stakes; licensed operators deduct both automatically.
